To protect your rights, this "Vividime Privacy Policy" (hereinafter referred to as "this Privacy Policy") explains how Vividime collects, uses, and stores your personal information, as well as the rights you have. Please note that you are not required to provide the personal information we request. Definitions

VividimeBI: Refers to the business intelligence data analytics platform provided by Vividime Technology. For details, please refer to the software product introduction and description on the Vividime Technology product website (www.vividime.com). Vividime Technology has the right to change the software product name and functions.

Enterprise User: Refers to the individual or organization that purchases and deploys Vividime products and has administrative authority over the product, including but not limited to legal entities, regulatory agencies, other organizations, partnerships, or sole proprietorships (hereinafter referred to as "Enterprise User"). Enterprise Users can create their data analytics platform through Vividime and open accounts to invite relevant individuals to join the platform as end users.

Server: Refers to the software and hardware system deployed on the server provided by the Enterprise User itself to provide services for Vividime products.

Enterprise User Administrator: Refers to the individual(s) designated by the Enterprise User who have administrative privileges for the Vividime system backend.

Individual User: Refers to an individual who is invited by an Enterprise User and logs into and uses Vividime products through an account created for them in the backend by the Enterprise User. Hereinafter referred to as "you" or "End User".

Personal Information: Refers to various types of information recorded electronically or otherwise that can identify a specific natural person's identity or reflect a specific natural person's activities, either alone or in combination with other information.

Sensitive Personal Information: Refers to personal information that, once leaked, illegally provided, or abused, may harm personal or property safety, easily lead to damage to personal reputation, physical and mental health, or discriminatory treatment, including ID numbers, personal biometric information, communication records and content, property information, location tracking, health and physiological information, transaction information, etc.

 

1. Prominent Disclosure Notice

When you first open VividimeBI, a pop-up window will display the core content of this Privacy Policy, including:

The types of device information we collect (such as Android ID, MAC address)

The main purposes for using the information (ensuring functionality, push notifications)

Third-party SDK data sharing

Only after you click "Agree" will we begin collecting information.

Background Data Collection Statement: This App does not actively collect location or device identifiers while in the background state. It only maintains necessary connections to the server to receive push messages.

 

2. Types of Information We Collect

To provide services to you and Enterprise Users, ensure normal service operation, improve and optimize our services, and protect account security, Vividime collects information in the following ways that you actively provide, authorize to provide, or that arises from your use of the service:

2.1 Account Information

When you first log in to Vividime, the account and password information used are pre-assigned to you in the backend by the Enterprise User Administrator. After logging in, you can modify your account password, phone number, email address, and other personal information through the account password and personal information modification functions provided by Vividime. This information will be reported to the server for storage. This information belongs to the Enterprise User and is managed by the Enterprise User Administrator. Vividime does not collect or process this information.

2.2 Information Collected When Using VividimeBI

When you use VividimeBI, to provide you and the Enterprise User with VividimeBI products and services, maintain the normal operation of our services, improve and optimize our service experience, and protect your account security, the system collects the following information:

2.2.1 Device Information

Based on the device model and permissions you grant during installation and use of VividimeBI, we collect device-related information, including device model, operating system, unique device identifiers (including Android ID, IMEI, OAID, MAC address), device location information (such as login IP address, GPS location, and Wi-Fi access point information that can provide relevant information), software installation list, and software version number.

Collection Timing: Collection only starts after you agree to this policy, used to ensure basic App functionality, device identification, and push services.

User Control: You can turn off certain permissions in your device settings (such as storage, location, camera), but turning them off may affect the use of corresponding functions.

2.2.2 Log Information

When you use VividimeBI, the system collects log information about your use of the service, including network access method, type and status, network quality data, operation logs, and service log information.

You understand and agree that the above information may be saved and recorded on the server.

2.3 Required Permissions

When you install and use VividimeBI functions, you need to enable phone storage permission and network access permission. Refusing to provide this permission will affect your normal use of VividimeBI.

 

 

2.4 Camera Permission

When using certain functions of VividimeBI (such as scanning QR codes to log in to the server, scanning QR codes to preview reports), you may need to enable camera permission. Refusing to provide this permission will only prevent you from using the corresponding functions and will not affect your use of other functions that do not rely on this permission.

2.5 Push Notification Permission

When using the push function of VividimeBI, you may need to enable push notification permission. Refusing to provide this information will only prevent you from using the corresponding function and will not affect your use of other functions that do not rely on this function.

2.6 Information from Third Parties

Enterprise Users may publish applications developed by themselves or by other third parties within VividimeBI for you to use. During use, the providers of these functions may collect, use, and store your relevant data or information.

To ensure push notifications, sharing, image loading, QR code scanning, and other functions, VividimeBI integrates the following third-party SDKs: Jiguang Push SDK, Xiaomi Push SDK, Huawei Push SDK, OPPO Push SDK, vivo Push SDK, Meizu Push SDK, Fresco Image Library, WeChat Sharing SDK, QQ Sharing SDK, and ZXing QR Code Scanner. These SDKs may collect your device information (IMEI/MAC/Android ID/IDFA/OAID/UAID/OpenUDID/GUID/SIM card IMSI information, etc.) and network information and location information (IP address, WiFi information, base station information, etc.). Before deciding whether to use such services, please consult your Enterprise User Administrator and fully understand their personal information and privacy protection policies.

Please understand that the functions and services we provide to you are constantly being updated and developed. If a function or service not mentioned above requires the collection of your information, we will separately inform you of the content, scope, and purpose of information collection through page prompts, interaction processes, website announcements, etc., to obtain your consent.

3. How We Store This Information

3.1 Location of Information Storage

Except for the third-party information specifically described above, all other information is stored on the Enterprise User's own server. If you need to know the specific geographic location of the Enterprise User's server, please consult your Enterprise User Administrator.

3.2 Duration of Information Storage

Generally, we retain your personal information only for as long as necessary to fulfill the purposes for which it was collected. For enterprise-controlled data where the Enterprise User can independently set the retention period, the system will retain relevant information based on the Enterprise User's settings. For specific storage rules, please consult your Enterprise User Administrator.

3.3 User Data Deletion and Account Cancellation

If you are an End User logging in with an enterprise account and need to delete your personal information or cancel your account, please first contact your Enterprise User Administrator. We will cooperate with the Enterprise User to complete the data deletion operation.

If you are an Enterprise User Administrator, you can directly delete user accounts and their associated data in the VividimeBI backend system.

We will complete the data deletion process within 30 days of receiving a valid deletion request.

4. How We Protect This Information

4.1

We strive to provide security protection for user information at the system level to prevent information loss, improper use, unauthorized access, or disclosure.

4.2

We will recommend that Enterprise Users use various security protection measures to ensure information security within a reasonable security level. For example, we use encryption technology (such as SSL/TLS) and other means to protect your personal information.

4.3

Because the Vividime system is deployed on the Enterprise User's own server and network environment, the security of the Vividime system deployment and basic operating environment is guaranteed by the Enterprise User. We will provide the Enterprise User with reasonable security recommendations for the basic operating environment. Different Enterprise Users may adopt different security strategies based on their own security needs. For information about the protection measures for the Enterprise User's basic environment, please consult your Enterprise User Administrator.

5. How We Use Information

5.1

The device information and log information obtained by the authorized system during the use of VividimeBI are mainly used to ensure the normal operation of system functions and will not be used for any other commercial purposes.

5.2

During the use of VividimeBI, Enterprise Users may upload, store, or analyze their business data (such as sales records, customer information, etc.). This data is controlled by the Enterprise User, and Vividime only acts as a data processor providing services according to the Enterprise User's instructions. If you wish to understand how this data is specifically used, please directly contact your Enterprise User Administrator.

5.3

The software installation list collected by the App is mainly used to identify whether reports can be shared to third-party applications such as QQ, WeChat, Enterprise WeChat, and DingTalk.

5.4

The collection of MAC addresses is mainly used for receiving SMS messages, identifying unique users, ensuring accurate delivery of push messages, optimizing push channel resources, improving message delivery rates for developers based on the activity of different apps on the device, and providing smart tags and business statistics display services for developers.

5.5

Network and location information is mainly used by Jiguang to optimize network connection requests with Jiguang servers, ensuring service stability and continuity, and enabling regional push functionality.

6. Information Sharing and Provision to Third Parties

Except for the necessary data transmission to third-party systems described above to ensure the use of system functions, the system itself will not automatically share or transfer your personal information to third parties.

To ensure push notifications, sharing, statistical analysis, and other functions, we integrate the following third-party SDKs. They will only initialize and collect necessary information after you agree to this Privacy Policy. You can refer to the information below:

Statement on No Data Collection Before User Consent:
We have technically configured all third-party SDKs to ensure that they do not initialize or collect any personal information before you have agreed to this Privacy Policy.

7. Your Personal Information Rights

Under applicable privacy laws, you have the following rights regarding your personal information:

 

Right to Access: You can log in to VividimeBI to view your account information.

Right to Rectification: You can directly modify your phone number, email address, and other personal information within the system.

Right to Deletion: You can apply for the deletion of your data through the Enterprise User Administrator, or contact us.

Right to Withdraw Consent: You can turn off relevant permissions in your device settings to withdraw consent for information collection.

Right to Complain: If you believe we have not legally processed your information, you can contact us or file a complaint with a supervisory authority.

8. Google Play Data Safety Form Consistency Statement

The content of the "Data Safety" form we filled out in the Google Play Console is fully consistent with this Privacy Policy. You can view the form summary in the Google Play Store to understand the types of data we collect, how we use it, and how we share it.

9. Changes to This Privacy Policy

We may revise this Privacy Policy from time to time. When policy terms change, we will notify you through an official website announcement (https://www.vividime.com).

10. Miscellaneous

Because Vividime products are deployed on servers independently controlled by Enterprise Users, and are managed and maintained by the Enterprise User or its authorized management personnel, how the Enterprise User ultimately uses these functions to collect, store, and use information needs to be consulted with the Enterprise User's management. This policy can only describe the privacy information collection capabilities contained in the product and the general scope and storage methods of collection and use.

Vividime User Agreement

Welcome to use Vividime Technology Business Intelligence Software Product (hereinafter referred to as "VividimeBI"). The following terms and conditions constitute the agreement (hereinafter referred to as "this Agreement") reached between you and VIVIDATA PTE. LTD. (hereinafter referred to as "Vividime Technology") regarding the use license of VividimeBI. Once you open VividimeBI, you need to choose whether you agree to accept the following terms and conditions. If you do not agree to accept all the terms and conditions, you will not be able to use VividimeBI.

VIVIDATA PTE. LTD. has the right to modify the aforementioned terms and conditions at any time, and only needs to announce them on the Vividime Technology product website (www.vividime.com) without obtaining your prior consent. The modified terms shall take effect immediately upon announcement. After Vividime Technology modifies the terms of the agreement, your continued use of VividimeBI shall be deemed as your acceptance of the modified terms.

Unless authorized in writing by Vividime Technology, no one may modify this Agreement.

Article 1 Definitions

Unless otherwise specified in this Agreement, the following terms have the following meanings:

VividimeBI: Refers to the business intelligence data analytics platform provided by Vividime Technology. For details, please refer to the software product introduction and description on the Vividime Technology product website (www.vividime.com). Vividime Technology has the right to change the software product name and functions.

Article 2 How to Use VividimeBI

1.You must obtain or use VividimeBI through official channels of Vividime Technology. Vividime Technology shall not bear any responsibility for the consequences caused by obtaining or using it through other means.

2.Vividime Technology reserves the right to change, upgrade, modify, or transfer VividimeBI and its related functions at any time at its sole discretion. Vividime Technology further reserves the right to develop new functions or services in other languages within the VividimeBI software system. The provision of all the above new functions and software services, unless otherwise stated by Vividime Technology, shall still be governed by this Agreement.

 

Article 3 Software License Fee

1.The software license fee is charged according to the relevant fee standards of VividimeBI. Vividime Technology will announce the fee standards on the VividimeBI product website in advance.

2.All fees shall be paid in advance through the payment methods accepted by Vividime Technology. The aforementioned software license fee does not include any other taxes, fees, or related remittance expenses, otherwise you shall make up the payment or pay such expenses yourself.

3.Unless otherwise agreed in this Agreement, the software license fee you pay will not be refunded.

4.Free trial services should not be deemed as VividimeBI waiving the right to charge fees. Vividime Technology reserves the right to notify you at any time and charge corresponding fees.

5.Vividime Technology has the right to unilaterally adjust the fee standards and charging methods at any time according to the actual situation and announce them on the VividimeBI product website without obtaining your prior consent. However, users who have paid the software license fee before the adjustment date will not be affected.

Article 4 Your Rights and Obligations

1.You guarantee that the registration information you submit to Vividime Technology is true, accurate, timely, complete, and comprehensive, and that you continuously update the registration information to meet the requirements of timeliness, completeness, and accuracy; it does not contain any content that violates the applicable laws of your jurisdiction, and all activities you engage in through VividimeBI are legal, true, and do not infringe upon the legitimate rights and interests of any third party.

2.You promise Vividime Technology that your use of VividimeBI complies with the laws and regulations of your region. You will not use VividimeBI for any illegal purpose or any purpose prohibited by this Agreement, terms, or notices.

3.You guarantee not to sell, resell, copy, or develop the usage rights granted by Vividime Technology; not to imitate Vividime Technology's products and services for commercial purposes; not to copy or imitate Vividime Technology's design concepts, interfaces, functions, and charts; not to modify or create derivative products based on this software or its content without the permission of Vividime Technology.

4.You further agree not to copy, translate, modify, adapt, enhance, decompile, disassemble, reverse engineer, disassemble, sell, sublet, or use any part of Vividime Technology (software products, page logos, service brands, information, information) for any commercial purpose. You agree to bind your employees, agents, consultants, or advisors who need to use Vividime Technology to comply with the foregoing obligations, and be responsible to Vividime Technology for their violation of the foregoing provisions as if you had violated them yourself.

5.You agree that if you use Vividime Technology to provide services to any third party, Vividime Technology shall not bear any responsibility for any disputes between you and the third party.

6.You promise to bear full responsibility for all legal consequences arising from your activities through Vividime Technology. If Vividime Technology or any third party bears related responsibilities due to your use of Vividime Technology, you shall fully compensate Vividime Technology or any third party for related expenses and losses, including reasonable attorney fees.

7.If you violate any terms of this Agreement and cause losses to Vividime Technology or other users, you must bear full compensation liability. If Vividime Technology bears the above liability, you agree to compensate Vividime Technology for related expenses and losses, including reasonable attorney fees.

8.You agree that if you violate any terms of this Agreement or any rules or notices of Vividime Technology, Vividime Technology has the right to unilaterally determine and immediately terminate your use of VividimeBI without prior notice and without refunding any fees collected.

9.You agree that VividimeBI collects software usage licenses from users through automatic email sending and other methods to determine the legitimacy of users' use of VividimeBI.

10.You agree to accept various information services provided by Vividime Technology while using VividimeBI.

 

Article 5 Rights and Obligations of Vividime Technology

1.Vividime Technology will license you to use VividimeBI in accordance with the provisions of this Agreement.

2.Vividime Technology has the right to copy and save your information on its servers and use it to contact you for your benefit.

3.Vividime Technology has the right to delete any information or links that violate laws, regulations, software license agreements, or rules, including those that Vividime Technology has reasonable suspicion of. Vividime Technology has the right to independently determine whether the information you provide falls within the above scope.

4.Vividime Technology has no obligation to supervise your use of VividimeBI. However, Vividime Technology reserves the right to terminate your use of VividimeBI at any time, without notice, and for any reason.

5.Vividime Technology reserves the right to disclose any information at any time as required by applicable laws, regulations, legal procedures, or regulatory agency requirements, or to edit, refuse to transmit, or delete any information or materials in whole or in part at its sole discretion.

6.Vividime Technology guarantees the legality of the VividimeBI it provides. This software product is provided "AS IS" and does not contain any malicious code intended to damage your computer data or obtain your privacy.

7.The above guarantees will replace all other guarantees. To the maximum extent permitted by applicable law, all other guarantees, conditions, and statements, whether express, implied, oral, statutory, or otherwise, whether arising under this Agreement or other agreements, are hereby superseded, including but not limited to, implied guarantees of non-infringement, merchantability, and fitness for a particular purpose.

8.If you are deleted from information or have your VividimeBI license terminated by Vividime Technology due to violation of any terms of this Agreement, the fees you have paid will not be refunded.

 

Article 6 Third-Party Service Description

You understand and confirm that VividimeBI may contain services provided by third parties. Vividime Technology provides these functional modules only for your convenience. If you need to use such services, you should enter into a service agreement with the third-party service provider separately, pay the corresponding fees, and bear the possible risks. Vividime Technology does not provide any form of guarantee for services provided by third parties.

Article 7 Intellectual Property

1.Vividime Technology owns the copyright, trade secrets, and other related intellectual property rights of VividimeBI as stipulated in this Agreement, including various documentation related to VividimeBI. Other rights not mentioned in this Agreement are also reserved by Vividime Technology.

2.Vividime Technology, vividime.com, VividimeBI, and related Vividime Technology logos are the intellectual property of Vividime Technology and are protected by copyright, trademark, and other intellectual property laws. Unauthorized copying, imitation, use, or publication of the above logos is prohibited.

3.Without the prior written consent of Vividime Technology, you shall not implement, utilize, transfer, or license any third party to implement, utilize, or transfer the above intellectual property for any profit or non-profit purposes.

Article 8 Termination

Vividime Technology has the right to immediately terminate your right to use VividimeBI without prior notice and without assuming any liability under any of the following circumstances:

(1) You fail to pay the software license fee for the next payment period after the expiration of the paid use period;
(2) You violate the terms of guarantees, consents, and promises in this Agreement;
(3) You violate the terms, agreements, rules, notices, etc. of the Vividime Technology website and/or other Vividime Technology affiliated company websites, resulting in termination of service by any of the aforementioned websites;
(4) Other circumstances where Vividime Technology unilaterally determines that your use of VividimeBI should be terminated immediately.

After this Agreement is terminated, you must immediately stop using VividimeBI and destroy all documents related to VividimeBI or related media copies provided by Vividime Technology within three (3) days. The termination of this Agreement shall not be deemed to exempt you from the obligations you should have performed during the term of this Agreement, including but not limited to payment obligations.

Article 9 Disclaimer and Limitation/Exclusion of Liability

1.Vividime Technology shall not be liable to you or any third party for any damage of any other nature arising from interruption or inoperability of telecommunications systems or the Internet, technical failures, computer errors or viruses, information damage or loss, or other causes beyond Vividime Technology's reasonable control.

2.Vividime Technology does not warrant that VividimeBI will be uninterrupted or error-free, that Vividime Technology will correct all defects in VividimeBI, or that VividimeBI will meet all your requirements.

3.If due to reasons attributable to Vividime Technology, VividimeBI experiences abnormal interruption or other technical failures, you agree that the sole compensation you receive shall not exceed the total amount of relevant software license fees collected by Vividime Technology under this Agreement.

4.To the extent permitted by applicable law, neither party shall be liable to the other party for any loss of data and/or damage and any indirect, incidental, special, or consequential damages (including but not limited to lost profits, business interruption, loss of commercial information, loss of goodwill, or other economic losses).

5.If you are dissatisfied with any part of VividimeBI or any part of the terms of this Agreement, your sole and exclusive remedy is to stop using VividimeBI.

Article 10 Force Majeure

If events such as hacker attacks, regulatory agency controls, or network communication failures occur that cannot be foreseen regarding their occurrence and consequences, both parties confirm that this constitutes force majeure. Both parties shall negotiate to decide whether to terminate this Agreement, waive the performance of part of the obligations under this Agreement, or postpone the performance of this Agreement based on the extent to which the force majeure affects the performance of this Agreement.

Article 11 Governing Law and Dispute Resolution

1.The interpretation, validity, and performance of this Agreement shall be governed by generally accepted principles of international commercial law, with reference to general industry practices. For specific matters where there is no clear legal provision, they shall be handled in accordance with the principles of fairness, reasonableness, and good faith.

2.If a dispute arises between the parties regarding the signing, performance, or interpretation of this Agreement, both parties shall endeavor to resolve it through friendly negotiations. If negotiation fails, both parties agree to submit the dispute to the Singapore International Arbitration Centre (SIAC) for arbitration in accordance with the arbitration rules effective at the time of applying for arbitration. The place of arbitration shall be Singapore, and the language of arbitration shall be English. The arbitral award shall be final and binding on both parties.

Article 12 Assignment of Agreement

Unless obtaining the prior written consent of Vividime Technology, you shall not assign the rights and obligations under this Agreement to any third party.

Article 13 Miscellaneous

1.This Agreement constitutes the complete agreement between you and Vividime Technology regarding the use of VividimeBI and supersedes any prior oral or written consensus reached between the parties on any matters contained herein.

2.If any provision of this Agreement is deemed invalid or unenforceable, the above provision may be severed, and the remaining parts shall remain legally effective.

3.The headings of this Agreement are for convenience only and do not define, limit, construe, or describe the scope or boundaries of the provisions.

4.Vividime Technology's waiver of rights provided in this Agreement in the event of your negligence or breach shall not be deemed a waiver of your other or future similar negligence or breach.

5.Vividime Technology has the right to modify this Agreement at any time based on changes in applicable laws and regulations, the development of the Internet, and adjustments to the company's operating conditions and strategies. You need to read and confirm the latest "VividimeBI Software License Agreement" to continue using VividimeBI. When a dispute arises, the latest agreement shall prevail. If you do not agree to the changed content, you can notify Vividime Technology in writing to terminate your use of VividimeBI and delete VividimeBI yourself. If you continue to use VividimeBI, you are deemed to accept the changes to this Agreement.

Article 14 Third-Party Software Module License Agreement
